TERMS OF SERVICE & CUSTOMER AGREEMENT

BY PLACING AN ORDER, SUBMITTING YOUR MOTORCYCLE FOR SERVICE, VISITING OUR WEBSITE, OR OTHERWISE ENGAGING WITH LUCKY 7 CUSTOM CYCLES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES OR WEBSITE.

These Terms constitute a binding contract between you (“Customer,” “you,” or “your”) and Lucky 7 Custom Cycles LLC and its affiliated locations (collectively, “Lucky 7,” “we,” “us,” or “our”). We reserve the right to amend these Terms at any time; continued use of our services after any amendment constitutes acceptance of the revised Terms. 

1. Scope of Services

Lucky 7 Custom Cycles provides motorcycle customization, painting, aftermarket parts installation, parts sales (in-store and online), and related services. These Terms govern all such interactions, whether in person, over the phone, or through our website at lucky7customcycles.com.

2. Customer Responsibilities

2.1  Knowledge of Purchase

It is the Customer’s sole responsibility to read and understand product descriptions, service estimates, and all order details before completing a purchase or authorizing work. Customers who are uncertain about specifications, fitment, or service scope MUST contact Lucky 7 prior to purchase. Lack of understanding does not constitute grounds for a refund or dispute.

2.2  Legal Compliance

The Customer is solely responsible for ensuring that any parts purchased or modifications performed comply with all applicable federal, state, and local laws, regulations, and safety standards, including—but not limited to—emissions requirements, lighting regulations, and noise ordinances. Lucky 7 does not guarantee that any product or modification meets the requirements of any specific jurisdiction.

2.3  Motorcycle Condition & Pre-Existing Issues

Customers submitting a motorcycle for service represent that the vehicle is in a reasonably safe condition to be worked on and that they have disclosed all known defects, prior repairs, and modifications. Lucky 7 is not responsible for damage arising from pre-existing conditions, undisclosed modifications, or structural deficiencies discovered during the course of work.

3. Estimates, Work Authorization & Pricing

3.1  Written Estimates

All estimates are good-faith approximations based on information available at the time of inspection. Actual costs may vary if additional issues are discovered during the work. Lucky 7 will notify the Customer of any material cost overrun before proceeding.

3.2  Work Authorization

No work shall begin until the Customer provides written or documented verbal authorization. By signing or approving a work order, the Customer authorizes Lucky 7 to perform the specified services. Authorization by any person who presents the motorcycle is deemed authorization by the registered owner.

3.3  Abandoned Vehicles

A motorcycle left at any Lucky 7 location for more than thirty (30) days after the Customer has been notified that the work is complete—or after any invoice remains unpaid for thirty (30) days—may be subject to applicable state lien laws, including public auction to satisfy outstanding charges. Lucky 7 will provide notice to the Customer as required by applicable law before exercising any lien rights.

3.4  Storage Fees

After a seven (7) day grace period following the completion notice, Lucky 7 reserves the right to charge a storage fee of up to $30 per day until the motorcycle is retrieved and all outstanding balances are paid in full.

4. Parts, Fitment & Product Information

4.1  Fitment Accuracy

To the best of our knowledge, all fitment and application information published on our website and in our materials is accurate as of the date of publication. Because new vehicle models are continuously introduced, Lucky 7 cannot guarantee fitment information for all vehicles. Customers should verify compatibility by contacting us at [email protected] before ordering.

4.2  No Regulatory Compliance Guarantee

Lucky 7 does not warrant that any part or modification complies with the laws or regulations of any jurisdiction. It is the Customer’s responsibility to verify compliance with all applicable laws before installation and use.

4.3  Third-Party & Aftermarket Parts

Lucky 7 sells and installs third-party and aftermarket parts. Manufacturer warranties, if any, are governed by the respective manufacturer’s terms. Lucky 7 passes through any available manufacturer warranty but makes no independent warranty on third-party products beyond what is required by applicable law.

5. Payment Terms

5.1  Payment Due

Full payment for all products and services is due prior to the release of any vehicle or shipment of any order. Lucky 7 accepts major credit cards, cash, and approved financing.

5.2  Financing

All sales completed through third-party financing platforms (including Snap, Klarna, and Affirm) are FINAL upon execution of the financing agreement. Customers must review and confirm all order details before signing financing paperwork. Financed sales may not be cancelled except in cases of documented shipping damage by the carrier.

5.3  Returned Checks & Chargebacks

In the event of a returned check or unauthorized chargeback, the Customer will be liable for the original amount plus a $35 returned-payment fee and any associated bank or processing fees. Lucky 7 reserves the right to pursue all legal remedies available, including referral to a collection agency and reporting to applicable credit bureaus.

6. Shipping & Delivery

6.1  Processing & Delivery Times

Orders are typically processed within three (3) business days of purchase. Delivery within the continental United States generally occurs within 7 – 14 business days after processing, though some orders may require longer. Lucky 7 does not guarantee any specific delivery date.

6.2  Shipping Confirmation

Once an order ships, the Customer will receive tracking information via the email address on file. It is the Customer’s responsibility to ensure a secure delivery address is provided. Lucky 7 is not responsible for packages that are lost or stolen after the carrier’s confirmed delivery scan.

6.3  Damaged Shipments

If a package arrives visibly damaged, the Customer should refuse delivery and contact Lucky 7 immediately. If damage is discovered after delivery, the Customer must report it within 24 hours of the confirmed delivery time to be eligible for a claim. Claims reported after 24 hours will not be honored.

6.4  Refused & Undeliverable Shipments

Orders that are refused without prior authorization from Lucky 7, or that are returned as undeliverable due to an incorrect or unreachable address provided by the Customer, may be reshipped at the Customer’s expense. Refunds for refused or undeliverable shipments will be subject to a 30% restocking fee, and original shipping charges are non-refundable.

7. Returns & Refunds

7.1  All Sales Final

All sales are final. Lucky 7 does not accept returns or issue refunds except in the limited circumstances described below, and only upon management’s written authorization.

7.2  Return Authorization

To request a return, the Customer must email [email protected] within 24 hours of delivery with the order number, a description of the issue, and supporting photographs. No item may be returned without a Return Authorization (RA) number. Items returned without prior authorization will not be refunded, and return shipping costs remain the Customer’s responsibility.

7.3  Eligibility Conditions

To be eligible for an authorized return, items must be:

  •       Unused and in original, unaltered condition
  •       In original, undamaged packaging
  •       Free from any installation, modification, or alteration of any kind
  •       Accompanied by all original accessories and documentation

7.4  Restocking Fee

All authorized returns are subject to a 30% restocking fee, deducted from any refund. Original and return shipping costs are non-refundable.

7.5  Refund Timeline

Once a return is received and inspected, please allow up to four (4) weeks for your refund to be processed, which includes: 5 – 10 business days for transit, 3 – 5 business days for processing, and 5 – 10 business days for your bank to post the credit.

7.6  Services — No Refund

Labor and service fees are non-refundable once work has commenced. If Lucky 7 is unable to complete an agreed service, any applicable refund will be limited to the unearned portion of the labor charge, less any parts, materials, or third-party costs already incurred.

8. Warranty Disclaimer

ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. LUCKY 7 DOES NOT WARRANT THAT PRODUCTS WILL BE FREE OF DEFECTS, OR THAT SERVICES WILL MEET ANY PARTICULAR STANDARD NOT EXPRESSLY AGREED TO IN WRITING.

Lucky 7’s warranty obligations are limited solely to those expressly set forth in a separate written warranty document, if any, signed by an authorized representative.

9. Assumption of Risk & Release of Liability

9.1  Inherent Risk of Motorcycle Customization

The Customer acknowledges that motorcycle customization, including painting, aftermarket parts installation, and other modifications, involves inherent risks, including but not limited to mechanical failure, loss of vehicle control, personal injury, and property damage. The Customer voluntarily assumes all such risks.

9.2  Release & Indemnification

By engaging Lucky 7’s services, the Customer, on behalf of themselves and their heirs, successors, and assigns, RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE Lucky 7 Custom Cycles, its owners, members, managers, employees, agents, contractors, and affiliated entities (the Released Parties) from any and all claims, demands, losses, liabilities, and expenses (including attorney’s fees) arising out of or related to:

  •       The purchase, installation, use, or misuse of any product sold or installed by Lucky 7;
  •       Any modification performed by Lucky 7 or by the Customer after the service;
  •       Mechanical failure, accidents, or incidents involving a motorcycle that has been serviced or customized by Lucky 7;
  •       Acts of God, natural disasters, or events beyond Lucky 7’s reasonable control;
  •       The Customer’s failure to comply with any applicable law, regulation, or safety standard.

9.3  Indemnification by Customer

The Customer agrees to indemnify, defend, and hold harmless the Released Parties against any third-party claims, damages, penalties, and expenses arising from the Customer’s use of products or services, violation of these Terms, or the operation of any vehicle serviced or modified by Lucky 7.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUCKY 7’S TOTAL LIABILITY TO THE CUSTOMER FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS, ANY PRODUCT, OR ANY SERVICE SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY THE CUSTOMER TO LUCKY 7 FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL LUCKY 7 BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF USE, LOSS OF DATA, OR PERSONAL INJURY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, Lucky 7’s liability is limited to the fullest extent permitted by law.

11. Website Use

11.1  Permitted Use

The Lucky 7 website and its content are provided for personal, non-commercial informational purposes only. You may not copy, reproduce, distribute, or create derivative works from any content on our website without Lucky 7’s prior written consent.

11.2  Accuracy of Information

Website content, including pricing, product availability, and fitment information, may not reflect real-time accuracy. Lucky 7 reserves the right to correct errors and update information at any time without notice. Submission of an order at an incorrect price does not obligate Lucky 7 to honor that price.

11.3  Third-Party Links

Our website may contain links to third-party websites for convenience only. Lucky 7 does not endorse, control, or assume responsibility for the content or practices of any third-party site. Access to third-party sites is at your own risk.

11.4  Intellectual Property

All website content, including text, images, logos, and design, is the copyrighted and proprietary property of Lucky 7 Custom Cycles. All rights reserved. Unauthorized reproduction or use is strictly prohibited.

11.5  User-Submitted Content

Any feedback, reviews, photos, or other content submitted to Lucky 7 through our website or social media channels is granted to Lucky 7 as a non-exclusive, royalty-free, perpetual license to use, reproduce, and publish such content in any medium, without compensation to the submitter.

12. Privacy & Customer Data

Lucky 7 collects personal information (including name, contact details, and payment information) solely to process orders and deliver services. We do not sell customer data to third parties. By engaging our services, you consent to the collection and use of your information as described herein. Payment card data is processed by third-party PCI-compliant processors and is not stored by Lucky 7.

13. Dispute Resolution

13.1  Informal Resolution

Before initiating any formal legal proceeding, the Customer agrees to first contact Lucky 7 in writing at [email protected] and provide a detailed description of the dispute. Lucky 7 will respond within fifteen (15) business days. The parties agree to negotiate in good faith to attempt to resolve the dispute informally.

13.2  Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or Lucky 7’s products and services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as otherwise required by applicable law. The arbitration shall be conducted in Tarrant County, Texas. THE CUSTOMER WAIVES THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

13.3  Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any matter not subject to arbitration shall be brought exclusively in the state or federal courts located in Tarrant County, Texas, and the Customer consents to personal jurisdiction therein.

13.4  Time Limitation on Claims

Any claim arising from the purchase of a product or performance of a service must be brought within one (1) year of the date the claim accrued. Claims not brought within this period are permanently barred.

14. Miscellaneous

14.1  Entire Agreement

These Terms, together with any signed work order, invoice, or written estimate, constitute the entire agreement between the Customer and Lucky 7 and supersede all prior oral or written representations, agreements, or understandings relating to the same subject matter.

14.2  Severability

If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.

14.3  Waiver

Lucky 7’s failure to enforce any provision of these Terms on one occasion does not waive its right to enforce that provision in the future.

14.4  Modifications

Lucky 7 reserves the right to modify these Terms at any time. The revised Terms will be posted on our website with an updated effective date. Continued use of our services after the effective date constitutes acceptance.

14.5  Assignment

These Terms may not be assigned by the Customer without Lucky 7’s prior written consent. Lucky 7 may assign these Terms in connection with a merger, acquisition, or sale of substantially all of its assets.
